Fed Judge Rules Poker Not 'Predominated by Chance' -- Paves Way for Legal Online Return in US

U.S. District Judge Jack Weinstein ruled this week that Texas Hold 'Em was not "predominated by chance," and thus quashed the conviction of a New York business man who sold electric bicycles and, somehow, also featured Texas Hold'em games out of his warehouse. The owner had been charged with with conspiring to operate an illegal underground poker club.

"Because the poker played on the defendant's premises is not predominately a game of chance, it is not gambling," the 90-year-old judge wrote.

Judge Weinstein's decision won't immediately open the Internet to "would-be poker operators because other federal and state laws might prohibit those businesses. The ruling isn't binding outside of Judge Weinstein's district, and is subject to appeal."
