Murphy sued for copyright infringement in 2008 as the station did not credit Murphy, which he contended was a copyright infringement and violation of the Digital Millennium Copyright Act. He also sued for defamation, saying that Rossi & Carton said he was gay.
The case has been dismissed, reinstated ... both plaintiff & defendant motion's have been granted, denied AND ... granted and denied in part.
And now, in 2015? It is still an ongoing case. The most recent ruling:
Defendants' motion for partial summary judgment is granted in part and denied in part. Similarly, Plaintiffs Rule 56(d) motion is granted in part and denied in part. Last, Plaintiffs motion for a spoliation inference is denied without prejudice. Discovery in this matter should proceed on all remaining claims and defenses.
